Section 206 provides that, after 2 years from the date of enactment of this Act, certain counties may exercise an option to decline irrigation water service and receive all of the ad valorem tax contributions such county has paid to the District, with interest. In making such tax refund, the District is authorized to deduct the value of any benefits received by such county and administrative expenses incurred by the District.
Withdrawal from participation in the District pursuant to this section shall be accomplished in accordance with Utah State law.
The Committee would note that section 206(b)(2)(B) places restrictions on the use of funds by counties. An exception to the general restrictions is provided for Hatch Town Dam. Funds may be used to construct earthen dam on the Sevier River near the town of Hatch in Garfield County which would impound a maximum of 20,000-25,000 acre-feet of water.
